The City’s Appeal and Motion to Stay

Judge Castro’s Ruling: On June 13, 2019, the City filed its Notice of Appeal of Judge Castro’s May 30 Order. The City filed a Petition requesting the Minnesota Supreme Court to grant accelerated review of the underlying trial court decision. The City also filed a motion before Judge Castro, asking that the trial court stay its May 30 Order until 90 days after all appellate review had been completed. The Minnesota Supreme Court issued an Order on June 24, 2019, granting accelerated review, scheduling oral argument for August 20, 2019. Judge Castro issued an Order on June 27, staying that part of his previous May 30 Order which required the City to suspend enforcement of Ordinance 18-39 on June 30, pending the appeal to the Minnesota Supreme Court. Judge Castro’s June 27 Order denied the City’s motion to stay his Order that a referendum on the Ordinance be placed on the November 5, 2019, election ballot.
